1. Overview

This website, smallshiftgoods.com (the "Site"), is operated by Small Shift Goods ("Small Shift Goods," "we," "us," or "our"). These Terms of Service ("Terms") apply to your use of the Site and to any purchase you make from us.

By using the Site or placing an order, you agree to these Terms and to the policies they refer to, including our Refund & Return Policy, Shipping Policy, and Privacy Policy. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. We sell only to customers with shipping addresses in the United States.

3. Products and descriptions

• We try to describe and show our products accurately. Colors, sizes, and appearance may vary slightly from photos because of screens and lighting.
• Product specifications, such as heat levels, battery capacity, and run time, are typical values provided by the manufacturer. Real results vary with use and settings.
• We may change, limit, or discontinue any product at any time.
• Reviews and testimonials on the Site come from customers. They reflect individual experiences and are not a promise of any particular result.

4. Health and product-use disclaimer

Please read this section before using the product.

• Our knee massager is a personal comfort and wellness product. It is not a medical device. It has not been evaluated or cleared by the U.S. Food and Drug Administration (FDA). It is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
• Nothing on the Site, in our emails, or in our ads is medical advice. It does not replace advice from a doctor or other qualified health professional.
• Talk to your doctor before use if you:
  • are pregnant or may be pregnant;
  • have a pacemaker, defibrillator, or other electronic or metal implant, including a joint replacement;
  • have diabetes, neuropathy, reduced feeling in your skin, or poor circulation;
  • have a blood clot (DVT), varicose veins, or a bleeding disorder;
  • have skin that is broken, inflamed, infected, sunburned, or sensitive to heat or light;
  • take medication that makes you sensitive to light;
  • have epilepsy or are sensitive to flashing light;
  • have recently been injured or had surgery;
  • have any other medical condition or concern.
• Safe use:
  • Follow the instructions included with the product.
  • The device produces heat. Start on the lowest setting. Stop using it right away if you feel pain, burning, numbness, or discomfort, or if your skin becomes red or irritated.
  • Do not use it while sleeping, on children, or on anyone who cannot sense heat or remove the device by themselves.
  • Do not look directly into the lights.
  • Keep it away from water, and do not use it while charging.
  • Keep it out of reach of children and pets.
• You use the product at your own risk and are responsible for using it as directed.

5. Orders, pricing, and payment

• All prices are in US dollars (USD). Applicable sales tax is calculated at checkout.
• Placing an order is an offer to buy. We may accept or decline it. We may cancel or limit an order, for example if an item is out of stock, if there is a pricing or listing error, or if we suspect fraud. If we cancel an order after you have paid, we will refund you in full.
• If a price on the Site is clearly wrong because of a typo or technical error, we may cancel any orders placed at that price, even after confirmation. We will tell you and refund any amount you paid.
• "Compare-at" or "regular" prices reflect the price we or other sellers have offered for the same or a similar product. Discounts and promotions are subject to the terms stated with them and may end at any time.
• Payment is processed by third-party payment providers. We do not store your full card details.
• You agree that the payment information you provide is accurate and that you are authorized to use the payment method.

6. Shipping, returns, and refunds

Shipping is covered by our Shipping Policy. Returns, refunds, cancellations, and defective items are covered by our Refund & Return Policy. Both are part of these Terms.

Ownership and risk of loss pass to you when the carrier delivers the order to you. Our Shipping Policy explains how we help with lost or damaged packages.

7. Product warranty

If your product is defective, damaged on arrival, or not what you ordered, our Refund & Return Policy explains how we will replace or refund it.

Except as stated in our Refund & Return Policy, and to the fullest extent allowed by law, products are provided "as is," and we disclaim all other warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Some states do not allow these exclusions, so some of them may not apply to you.

8. Using the Site

You agree not to:

• use the Site for any unlawful purpose or in violation of these Terms;
• submit false information, fraudulent orders, or reviews that are fake or that you were paid to write without disclosing it;
• interfere with the Site's security or operation, or use bots or scrapers on it without our permission;
• upload viruses or other harmful code;
• copy, reproduce, or resell any part of the Site or our content without our written permission.

We may suspend or refuse service to anyone who breaks these Terms.

9. Content you submit

If you send us reviews, photos, comments, or other content, you confirm it is your own, honest, and not unlawful. You give us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce it in connection with our store and marketing. We may remove any content at our discretion. We will not edit reviews in a way that changes their meaning.

10. Intellectual property

The Site and its content, including text, graphics, logos, and design, belong to us or our licensors and are protected by intellectual property laws. Third-party trademarks belong to their owners.

11. Limitation of liability

To the fullest extent allowed by law:

• We, our owners, employees, suppliers, and service providers are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or loss of use, arising from your use of the Site or our products. This applies even if we were told such damages were possible.
• Our total liability for any claim relating to the Site or a product is limited to the amount you paid for the product that gave rise to the claim.

Nothing in these Terms limits liability that cannot be limited by law, such as liability for death or personal injury caused by our negligence, or for fraud. Some states do not allow certain limitations, so some of the above may not apply to you.

12. Indemnification

You agree to indemnify and hold harmless Small Shift Goods and its owners, employees, and service providers from claims, losses, and expenses, including reasonable attorneys' fees, that arise from your breach of these Terms, your misuse of a product against its instructions, or your violation of any law or third-party rights.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-law rules.

If you have a problem, please email support@smallshiftgoods.com first. Most issues can be solved quickly that way. If we cannot resolve a dispute informally within 30 days, it will be resolved in the state or federal courts located in Delaware. You and we consent to those courts' jurisdiction. You may also bring an individual claim in small claims court where you live, if it qualifies.

This section does not take away any rights you have under the consumer protection laws of the state where you live.

14. Changes to these Terms

We may update these Terms from time to time. When we do, we will post the new version on this page and update the "Last updated" date. The version in effect when you place an order applies to that order.

15. Other terms

• If any part of these Terms is found unenforceable, the rest stays in effect.
• If we do not enforce a right right away, we have not waived it.
• These Terms, together with the policies referred to above, are the entire agreement between you and us about the Site and your purchases.
